We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the U.S. Digital Millennium Copyright Act.
If Dealer Content or TracTru Content is, or in our opinion is, likely to be claimed to infringe, misappropriate or otherwise violate any third-party intellectual property right, or if a dealer’s use of the Services is enjoined or threatened to be enjoined, TracTru may, at our option and sole cost and expense:
• obtain the right for the dealer to continue to use the Services materially as contemplated by the subscription agreement;
• modify or replace the Services, in whole or in part, to seek to make the Services (as so modified or replaced) non-infringing while providing materially equivalent features and functionality; or
• by written notice to the dealer, terminate these Terms or suspend all or part of the Services, subject to termination.
